By accessing or using the websites, services, and platforms operated by MOD3RN Care Pty Ltd or MOD3RN Cloud Pty Ltd (“we”, “our” or “us”), you agree to comply with and be bound by these Terms & Conditions. If you do not agree, you must not use our services.

• MOD3RN Care: Provides virtual care, telehealth, AI-driven screening, and healthcare technology solutions.
• MOD3RN Cloud: Provides secure healthcare-focused private cloud hosting, storage, and data management solutions.

We reserve the right to modify, suspend, or discontinue any service at any time.

You must be at least 18 years old (or have parental/guardian consent) to use our services.

You agree to:

• Provide accurate, current, and complete information.
• Keep login credentials secure and confidential.
• Use our services in compliance with all applicable laws and regulations.
• Not use our platforms for unlawful, harmful, or fraudulent purposes.

All content, designs, trademarks, software, and data on our sites and services are owned by or licensed to us. You may not reproduce, distribute, or modify any content without prior written consent.

• MOD3RN Care: Health-related services are not a substitute for emergency medical care. Always seek immediate medical attention in an emergency.
• MOD3RN Cloud: Client data hosting is subject to agreed Service Level Agreements (SLAs) and data processing agreements.

Fees are as agreed in your contract or subscription. All amounts are payable in Australian dollars unless stated otherwise. Late payments may incur interest charges.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential loss arising from your use of our services.
• Services are provided “as is” without warranties except those expressly stated in your contract.

Nothing in these Terms limits rights you may have under the Australian Consumer Law.

We may suspend or terminate your access if you breach these Terms or applicable laws. You may also terminate your account in accordance with your service agreement.

These Terms are governed by the laws of New South Wales, Australia. Disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
